Privacy Policy

This Privacy Policy describes how OZGAR Inc. (EIN 364865904), 1621 Central Ave. #9050, Cheyenne, WY 82001, USA, including its affiliates, subsidiaries, and reselling partners ("Ozgar", "we", "us"), collects, uses, and discloses information from or about an identified or identifiable person, including information that can be associated with an individual ("Personal Data"). It also explains the choices available to you regarding your Personal Data.
1. Applicability of this Privacy Policy
This Privacy Policy applies to Ozgar's online collaboration tools and platform (including Ozgar.ai) and other interactions you may have with Ozgar (for example, customer support or the Ozgar Community). It covers the processing of any messages, text, files, images, video or audio recordings, or other content submitted through our Services ("Customer Content").
For the purposes of this Privacy Policy:
- Services
- means Ozgar's online collaboration tools and platform, including Ozgar.ai.
- Websites
- means Ozgar's websites and related online properties.
- Third‑Party Services
- means third‑party applications or software that integrate with our Services.
This Privacy Policy does not apply to Third‑Party Services, or to other third‑party products, services, or businesses.
The organization controlling the use of the Services (for example, your employer) is referred to as the "Organization". Individuals who are granted access to the Services by an Organization are referred to as "Users" (or "you"). The Organization and its Users (together, "Customers") are also bound by the General Terms and Conditions and any product‑specific terms, offers, or order forms (together, the "Agreement"), as applicable.
If you have questions about specific Organization settings and privacy practices, please contact the relevant Organization. If you received an invitation to join an Organization but have not yet created an account, please request assistance from the Customer that sent the invitation.
2. Identifying the Data Controller and Processor
Data protection laws in certain jurisdictions (including the EU General Data Protection Regulation ("GDPR")) distinguish between a "controller" and a "processor" of Personal Data. Whether Ozgar or the Customer acts as controller or processor depends on the type of data and the purposes for which it is used.
Customer Content
Customer is the controller for all Customer Content that is also Personal Data. As controller, the Customer may, for example, grant or remove access to an Organization, assign roles, configure settings, and access, modify, export, share, or remove information and apply its policies to the Services.
Ozgar acts as a processor for Customer Content that is Personal Data. Ozgar processes such Customer Content only on the Customer's request and in accordance with the Customer's written instructions, including the Agreement, the Customer's use of the Services, and as required by applicable law.

Services Data
Ozgar is the controller for "Services Data" (defined in Section 3). If, for any reason, Ozgar is deemed a processor of Services Data, such data will be processed only as permitted under applicable law (including, where relevant, Article 6 GDPR) and, where required, based on your consent.
Sub‑processors and international transfers
Ozgar relies on third‑party sub‑processors, such as the Microsoft Azure cloud platform. Where Personal Data is transferred to third countries (such as the United States), we apply safeguards required under applicable data protection regulations (including the EU‑U.S. Data Privacy Framework and/or Standard Contractual Clauses). Depending on your circumstances, your Organization may also be required to put appropriate safeguards in place.
3. The Types of Personal Data We Collect
Personal Data may be provided by you, obtained from third parties, and/or generated by us when you use the Services or Websites.
Customers routinely submit Customer Content to Ozgar when using the Services. In addition, Ozgar collects, generates, and/or receives the following types of Personal Data, other than Customer Content (the "Services Data"):
- Organization and account information: To create or update an Organization account, you or the relevant Customer may provide an email address, phone number, password, domain, and/or similar account details.
- Billing information: Customers purchasing a paid version of the Services may provide Ozgar (or its payment processors) with billing details such as credit card information, banking information, and/or a billing address.
- Service metadata: When you interact with the Services, metadata may be generated (for example, logs of Organizations, workflows, people, or features you view or interact with, and the types of files shared).
- Log data: Our servers may automatically collect information when you access or use our Websites or Services, including IP address, browser type and settings, dates and times of access, browser configuration and plugins, and language preferences.
- Device data: Information about devices accessing the Services, such as device type, operating system, device settings, application IDs, unique device identifiers, and crash data (depending on device type and settings).
- Location data: Approximate location information (for example, from a business address submitted by your employer, or an IP address). Ozgar may also collect precise location information from devices where enabled and based on your device settings/consent.
- Marketing and communications data: Marketing information and preferences, including your preferences for receiving marketing communications and your communication preferences.
- Cookie data: Cookies and similar technologies used in our Websites and Services. For details and opt‑out opportunities, please see our Cookie Policy.
- Email performance data: We may use a tracking pixel (for example, a clear GIF) in emails to track engagement and performance metrics. Much of this data is aggregated. You can turn off this tracking by disabling images in your email client.
- Community data: Information submitted on our websites or through participation in the Ozgar Community, forums, programs, contests, activities, events, or educational programs hosted by Ozgar (or a vendor).
- Call data: Our Customer Success team may record video or telephone calls for training and quality assurance. You will be notified when a recording is made and may request that we do not record calls.
- Additional data provided to Ozgar: If you use Ozgar's AI features pursuant to the Terms of Service, Services Data also includes data associated with your interactions with those technologies. We also receive Services Data when you request support, interact with our social media accounts, or otherwise communicate with Ozgar.
- Business data: Information about individuals from organizations, industries, Customers, (potential) partners, parent corporations, affiliates, subsidiaries, and our partners for cooperation and communication purposes.
Generally, no one is under a statutory or contractual obligation to provide Personal Data. However, certain Personal Data is collected automatically and, if some Personal Data (such as Organization setup details) is not provided, we may be unable to provide the Services.
Important note: The provisions in this Privacy Policy primarily relate to Customers' user and account data and do not cover submitted, transformed, or processed data from format mappings and transformations.
4. How We Use Personal Data
Customer Content that is Personal Data is used by Ozgar only in accordance with the Customer's instructions and as required by applicable law.
To the extent permitted under applicable law, Ozgar uses Services Data for legitimate interests in operating our Services, Websites, and business, including to provide, update, maintain, and protect our Services and Websites. This includes using Services Data to support delivery of the Services under the Agreement, create or update an Organization, prevent or address service errors, security or technical issues, and analyze and monitor usage of the Services (including product features, trends, and related activities).
We may also use Services Data to:
- Develop and improve our products and Services (including AI Features), provided you have not opted out where applicable.
- Comply with applicable law, legal process, or regulation.
- Support and communicate with you, including responding to requests, comments, and questions.
- Develop, test, and provide search, learning, and productivity tools and additional features.
- Conduct research and surveys (including customer satisfaction and user experience) and evaluate the effectiveness of our marketing campaigns.
- Send service, transactional, technical, and administrative communications (including account notices, security and fraud notices, and updates about the Services).
- Contact you for invoicing, account management, and related purposes and administer accounts, billing, and payments.
- Investigate and help prevent security issues and abuse.
If information is aggregated or pseudonymized so it can no longer reasonably be associated with an identified or identifiable natural person, Ozgar may use it for any business purpose.
5. AI Features
"AI Feature(s)" means any parts of the Services, including Ozgar's AI tools (for example, Ozgar.ai), that use large language models ("LLMs") or other machine learning ("ML") and/or artificial intelligence ("AI") to generate output.
Definitions
- Input(s)
- any data, content, or materials that a Customer submits to Ozgar's AI Features (for example, XML, JSON, spreadsheets, or database files).
- Output(s)
- the resulting image, text, table, database, or other content generated by the Services based on the Inputs.
Ozgar's AI Features may require you to provide Inputs, which are used to generate Outputs. To the extent permitted under applicable law, you retain ownership rights in Inputs and you own the Outputs to the extent permitted by applicable law and third‑party terms.
If Ozgar uses third‑party services to provide AI Features, Ozgar will take reasonable steps to inform you of any restrictions to your ownership in Outputs prior to your use of the relevant AI Feature. Due to the nature of AI Features, Outputs provided to you may be similar or identical to Outputs independently provided by Ozgar to other customers or users.
If you consent (or do not object, where permitted by law) to Ozgar's use of Inputs and Outputs to improve AI Features, you grant Ozgar a non‑exclusive, perpetual, irrevocable, worldwide, royalty‑free license to use your Inputs and Outputs for that purpose. Ozgar will remove direct identifiers when using Inputs and Outputs to improve AI Features consistent with industry standards. Customers are responsible for anonymizing Personal Data in advance where required.
Due to the nature of AI Features, Ozgar does not represent or warrant (a) that Outputs do not incorporate or reflect third‑party content or materials, or (b) that Outputs will not infringe third‑party intellectual property rights. Claims of intellectual property infringement or misappropriation by Outputs are not included in covered third‑party claims for indemnification by Ozgar under the applicable Agreement.
Ozgar does not endorse or guarantee that Outputs are accurate, complete, or current. Customers must independently review and verify all Outputs for usefulness, appropriateness, accuracy, and fitness for their purposes. Customers are solely responsible for the content of Inputs and their use of Outputs. The warranty disclaimers and limitations of liability in the Agreement also apply to use of AI Features.
Restrictions on use
Customer will ensure that its Inputs and use of Ozgar's AI Features comply with applicable laws. Customer will not (and will not permit anyone else to):
- Use the AI Features, Inputs, or Outputs to infringe third‑party rights (including intellectual property rights).
- Represent an Output as an original work or a wholly human‑generated work, or as being approved or vetted by Ozgar.
- Use AI Features for automated decision‑making or other processes with legal or similarly significant effects on individuals, unless performed with adequate human review and in compliance with applicable laws.
- Use AI Features for illegal, discriminatory, harassing, bias‑inducing, harmful, or unethical purposes or effects.
- Develop foundation models or other large‑scale models that compete with Ozgar's AI Features.
- Generate spam or content for dissemination for illegal activities.
- Use the Services outside the scope of the Agreement.
6. Data Retention
Ozgar retains Customer Content and Personal Data only in accordance with the Customer's instructions (including applicable terms in the Agreement) and as required by applicable law.
Deletion of Customer Personal Data may result in deletion and/or pseudonymization of an account and certain associated Services Data. Ozgar may retain Services Data for as long as necessary for the purposes described in this Privacy Policy.
Ozgar may retain certain types of Services Data after account deactivation for the period needed to pursue legitimate business interests, conduct audits, comply with (and demonstrate compliance with) legal obligations, resolve disputes, and enforce our agreements.
7. Data Disclosure and Sharing
Ozgar shares and discloses Personal Data only in accordance with a Customer's instructions, including the Agreement, and in compliance with applicable law. Where required, we share Personal Data with third parties only where we have obtained consent or are required by law.
We may share Personal Data in the following ways, to the extent permitted by law:
- When a User submits Customer Content (including Personal Data), it may be displayed to other Users who have access to the same Ozgar dashboard (for example, a User's name and profile may be visible).
- Owners, administrators, Users, and other Customer representatives may be able to access, modify, or restrict access to Personal Data (for example, an employer exporting logs of activity or modifying profile details).
- With sub‑processors that help provide the Services (for example, virtual computing and storage providers).
- With developers, partners, and others we engage to build Ozgar applications and/or integrate features.
- If we receive a request for Personal Data, we may disclose it if we reasonably believe disclosure is required by or consistent with applicable law, regulation, or legal process.
- To protect and defend the rights, property, or safety of Ozgar, its users, or third parties (including enforcing contracts or policies and investigating or preventing illegal activity, fraud, or security issues, including to prevent death or imminent bodily harm).
For the purposes of this section, Customers are responsible for anonymizing Personal Data in advance where required. We may assume anonymization has been completed once Customer consent (as described above) has been obtained.
Note: The provisions for disclosure and sharing relate to Customers' user and account data and do not cover submitted, transformed, or processed data from format mappings and transformations.
8. Security
Ozgar strives to protect Personal Data from unauthorized access or disclosure. However, no method of transmission over the Internet or method of electronic storage is completely secure. Ozgar cannot guarantee that Personal Data stored or transmitted to Ozgar will be completely safe, and we encourage you to use caution.
To the maximum extent permitted under applicable law, you acknowledge that Ozgar will not be liable if information about you is intercepted, accessed, and/or used by an unintended recipient.
9. Your Rights
Where Ozgar is the controller of your Personal Data (including user and account data), and subject to the rights granted to you under applicable law, you may have the right to:
- Request access to your Personal Data.
- Request a copy of your Personal Data that we process based on consent or to perform a contract with you.
- Request erasure of your Personal Data where we are not required to retain it for compliance with law or in connection with legal claims (we will inform you where an exemption applies).
- Request that we correct inaccurate information we maintain about you.
- Unsubscribe from direct marketing by using the "unsubscribe" link in marketing communications.
- Object to our processing where we rely on legitimate interests or perform a task in the public interest (we will assess your objection in light of applicable factors and reasonable expectations).
- Withdraw consent at any time where we rely on your consent; withdrawal will not affect the lawfulness of processing before withdrawal, to the extent permitted under applicable law.
10. Changes to this Privacy Policy
Ozgar may update this Privacy Policy from time to time. Laws, regulations, and industry standards evolve, and changes may also be necessary as we update our Services or business practices.
We will post changes on our website and encourage you to review this Privacy Policy periodically. If we make material changes, Ozgar will use commercially reasonable efforts to notify you and take additional steps as required by law.
If you disagree with changes to this Privacy Policy, you should deactivate your account and discontinue use of the Services. Contact the relevant Customer if you wish to request removal of Personal Data under their control.
